CARLOS JOSE NANEZ BY THE GRACE OF GOD AND OF THE HOLY APOSTOLIC SEE ARCHBISHOP OF CORDOBA IN THE REPUBLIC OF ARGENTINA
GIVEN: the perplexity of the Christian faithful of this Archdiocese of Córdoba which has become public kowledge, as a result of the publication of the work titled "Sin tapujos: la vida de un cura", published in the same City of Córdoba by the "La Docta" publishing company and printed in the press of Alejandro Graziani S.A. in May, 2004, whose author is Father José Guillermo Mariani; as well as the repeated public declarations of the author, both in homilies, and in mass media of communication; CONSIDERING: that it is necessary to bring tranquillity to the conscience of the faithful and give light to men of good will, given that "in the current social context, the Bishop has to be particularly close to his flock and [. ..] in cases of severe faults [...] that injure the testimony of the Gospel itself, especially by ministers of the Church, the Bishop [...] must intervene immediately, as established by Canonic norms, both for the correction and the spiritual good of the sacred ministry, as well as to repair scandal and re-establish justice [...]" (John Paul II, Apostolic Exhortation Pastores gregis, n0 21); 1. I ORDER: that Father José Guillermo Mariani, by virtue of this decree, must abstain from any declaration, whether spoken or written, whether public or private, whether in the preaching of homilies, or in meditations, or in any other form of expression, that may refer to the above-mentioned publication as an autobiography, or to any type of circumstances that may reach the various means of currently known means of mass communication; 2. I ORDER: that in accordance with canon 831 § 2 and of the General Decree of the Argentine Episcopal Conference of December 8, 1988, he will also abstain from any kind of declaration in the aforesaid mass media of communication, and his personal participation, live or pre-recorded, in any type or time of broadcast, whatever the purpose of the subject that is or may be dealt with; and he is likewise forbidden to make publications of any kind without authorization from the competent ecclesiastical authority; 3. If he should incur in any way, fully or partially, in any kind of non-compliance with the present penal precept that I establish in accordance with canon 49, such non-compliance will bring about the application of the dispositions of canon 1336 § 1, n0 4 of the Code of Canon Law; 4. All things to the contrary notwithstanding. 5. To be communicated to the party concerned in form of law. 6. To be filed and given to the Curia Registry. Given in Córdoba, in the seat of the Archbishopric, on the 30th day of the month of June, 2004.
